Personal Information Consent and Registration Terms and Conditions
The Registrant and AGIC Australia, hosted by Grain Trade Australia, hereby agree that the following Terms and Conditions form part of Australian Grains Industry Conference (AGIC Australia) agreement between the parties.
1. Definitions
The meanings of the terms used in these Terms and Conditions are set out below:
• EVENT ORGANISER means AGIC Australia and its associated agencies assisting with the event management of the EVENT
• EVENT means the Australian Grains Industry Conference to be held in Melbourne, from 31st July - 1st August 2024.
• REGISTRANT means the individual agreeing to be bound by the agreement with respect to their attendance at the EVENT.
• AGREEMENT means the agreement, which includes these Terms and Conditions, between EVENT ORGANISER and the REGISTRANT regarding the REGISTRANT’s attendance at the EVENT
• CLAIM means any action, suit, claim, proceeding, demand, loss, damages, cost and expense of any nature whatsoever.
• LOSS means any claim, action, damage, loss, liability, cost, charge, expense suffered or incurred, whether direct, indirect or consequential and whether arising in contract, tort (including negligence), statute or otherwise.
• Terms and Conditions means these Terms and Conditions, which form part of the agreement.
2. Limitation of liability and release
2.1 The EVENT ORGANISER and their directors, employees, agents and contractors, are not liable to the Registrant for any losses arising from or in any way connected with, the EVENT.
2.2 The Registrant releases and forever discharges the EVENT ORGANISER and their directors, employees, agents and contractors from all claims which the REGISTRANT may otherwise have for losses to property (including but not limited to personal property or belongings) or bodily injury or death howsoever caused, including negligence, arising from or in any way connected with, the EVENT.
3. Indemnity
The REGISTRANT indemnifies and holds harmless the EVENT ORGANISER and their directors, employees, agents and contractors, to the extent permitted by law, in respect of any claim by any person, including but not limited to an accompanying persons or another REGISTRANT, arising as a result of or in any way connected with the Registrant’s and/or any accompanying person’s attendance or actions at the EVENT.
4. Force majeure
If the EVENT is cancelled for reasons beyond the control of the EVENT ORGANISER, including but not limited to fire, flood, strikes, pandemic, riots, civil disturbance, government regulations, natural disaster, severe weather conditions, mechanical malfunction or other conditions which make it impossible, illegal or inadvisable to hold the EVENT, the EVENT ORGANISER will, (a) refund all such monies paid to the EVENT ORGANISER by the REGISTRANT less expenses incurred by the EVENT ORGANISER in reparation for the provision of the services and any fees charged by contracted suppliers.
5. Liability excluded for acts of terrorism
5.1 The EVENT ORGANISER does not cover any individual attending the EVENT in respect of loss, damage, costs or expenses arising directly or indirectly from terrorism. For the purposes of this exclusion, terrorism means any act including but not limited to the use or threat of force or violence by any person or group(s) of persons, whether acting alone or on behalf of or in connection with any organisation(s) or government(s) which from its nature or context is committed for, or in connection with, political, religious, ideological, ethnic or similar purposes or reasons including the intention to influence any government and or to put the public or any section of the public in fear.
5.2 The EVENT ORGANISER does not cover any individual attending the EVENT in respect of death, injury, illness, loss, damage, cost or expense of any nature directly or indirectly caused by, resulting from or in connection with, any action taken in controlling, preventing, suppressing or in any way relating to, terrorism as defined.
6. Change of Speakers/Sessions/Entertainment
The EVENT ORGANISER reserves the right to change the EVENT program due to circumstances beyond the EVENT ORGANISER control but will give the REGISTRANT prompt notification of these changes.
7. Privacy
The EVENT ORGANISER is collecting your personal information for the purposes of completing the registration above. The EVENT ORGANISER will use the personal information for the primary purpose or a directly related purpose. You understand that the personal information provided is for the purpose outlined above and shall otherwise remain private with the EVENT ORGANISER and will not be shared with any third parties, unless disclosure is required by law.
The EVENT ORGANISER may disclose your personal information to third parties outside of the EVENT who assist us in providing services for the EVENT. These may include (but not limited to) hotels, venues, exhibition hire companies, caterers.
7.1 The EVENT ORGANISERS will only use delegate information in relation to Grain Trade Australia, AGIC Australia and Asia events. In registering for this conference, relevant details may be incorporated into a delegate list for the benefit of all delegates, sponsors and exhibitors. Should you not wish to be included on the delegate list, please advise EVENT ORGANSIER via email at events@ausgrainsconf.com
7.2 Social media/photography. The EVENT ORGANISER is active on social media and also takes a range of photos for use in publicity and promotion activities. You consent to your photo being used by EVENT ORGANISER for social media, publicity, and promotion activities. If you do not wish your photo to be taken or utlilised in this manner, please advise the photographer at the time.
8. Changes to Registration details
All changes to your registration can be made in writing by email to the EVENT ORGANISERS. Do not submit another registration form.
8.1 If you can no longer attend and need to transfer your registration to another person, please contact the EVENT ORGANISERS who will be able to manually do this.
9. Cancellation of Face To Face Event
9.1 Cancellation by REGISTRANT- Please note that the Full Conference Ticket is not refundable but can be transferred to another delegate. Full Ticket can be converted to Virtual Recording Pass up to 10 days prior to the event, and a refund of the difference of the ticket will be provided. If such conversion is requested within less than 10 days from the event, Virtual Recording Pass will be offered with no option of a refund. This is due to hotel catering numbers reporting requirements.
9.2 Cancellation or postponement of the EVENT ORGANISER- The EVENT ORGANISER reserves the right to cancel or postpone the EVENT at any time in its sole discretion and for any reason, including circumstances beyond its control.
9.3 Expenses for and arrangements REGISTRANTS may make for travel and accommodation are at the REGISTRANTS sole risk. We recommend that REGISTRANTS consider making accommodation and transport arrangements that permit variation or cancellation with appropriate refunds. We further recommend that REGISTRANTS obtain insurance that will reimburse REGISTRANTS for accommodation and transport costs in the event of cancellation.
If the Event:
(i) is cancelled:
Reasonable endeavours will be made to notify the REGISTRANT and details of cancellation will be posted to the EVENT website. REGISTRANTS are responsible for checking for such notifications/alerts prior to the Event. In this instance, registration fees will be refunded.
(ii) is postponed or moved to a different venue:
Reasonable endeavours will be made to notify REGISTRANTS (in this clause a “Change of Venue/Date Notice”) and details of the postponement/venue will be posted to the EVENT website. REGISTRANTS are responsible for checking for such notifications/alerts prior to the Event;
On receipt of a Change of Venue/Date Notice, REGISTRANTS may:
– notify the EVENT ORGANISER that you cannot, or do not wish to, attend the EVENT as varied, in which case, subject to proof of purchase, a refund of monies actually received will be granted. The ORGANISER will not be liable for any losses REGISTRANTS incur as a consequence of such postponement, including but not limited to transportation or accommodation costs,
– notify EVENT ORGANSIERS that REGISTRANTS wish to attend the EVENT at its new (postponed) date(s) and/or venue, in which case, the monies paid by REGISTRANTS will be retained,
and if, within 14 days of the date of the Change of Venue/Date Notice, REGISTRANTS do not notify us in writing, REGISTRANTS are deemed to have registered for the EVENT at its new (postponed) date(s) and/or venue on these terms and conditions and the monies REGISTRANTS have paid will be retained as payment for the EVENT as varied.
10. Virtual (on-line) participation in the Event — If you register to participate in this EVENT, or any part of it, by virtual (on-line) means, REGISTRANTS agree that:
(a) it is the REGISTRANTS responsibility to ensure that they have appropriate technology, internet connectivity to participate;
(b) EVENT ORGANISERS are not liable for any interruption, delay sound or picture quality problems REGISTRANTS may experience because of REGISTRANTS inadequate technology or because of internet or power interruptions, or internet speed, or other connectivity problems REGISTRANTS may experience;
(c) REGISTRANTS are not entitled to a refund if REGISTRANTS are unable to participate, or if the quality of REGISTRANTS participation is diminished, because of the matters referred to in paragraphs (a) and (b) of this clause;
(d) If/when REGISTRANTS post questions or messages to others participating by virtual means, REGISTRANTS personal information may be shared with those persons; and
(e) You warrant that the home/work environment in which REGISTRANTS access the virtual component of the EVENT is safe and free of risk to REGISTRANTS health and safety.
11. Payment methods
11.1 Full payment, in cleared funds and in Australian dollars, of the registration fee, applicable GST, and all other monies due and payable in connection with the REGISTRANTS attendance at this EVENT must be made by credit card (VISA or Mastercard) at the time of your registration to attend the EVENT.
11.2 In certain circumstances by agreement of the EVENT ORGANISERS, payment is also available via Electronic Funds Transfer. Please contact events@ausgrainsconf.com if EVENT ORGANISER bank details are required. If paying via EFT, payment is required 7 days from the date of registration or by the start date of the EVENT, whichever is earliest. If you are seeking “early-bird” registration, EFT payment must be due by the closing date for payment set out in this website, but in any case, no later than 14 days from the date of registration.
You will be denied entry to the EVENT if your attendance fee is not paid in full, as provided above.
12. Special Requirements
If the REGISTRANT or any accompanying persons have any special dietary, cultural or health practices, it is the REGISTRANT responsibility to inform the EVENT ORGANISER s of any of these at the time of registration, to ensure these needs are able to be met during the EVENT. Whilst it may not be possible to guarantee that the special requirements can be accommodated, every reasonable effort will be made to do so and can only be done with prior advice.
13. Governing Law
13.1 This agreement is governed by the laws in force in the State of Victoria and each party irrevocably and unconditionally submits to the exclusive jurisdiction of the Victorian courts.
13.2 The EVENT ORGANISERS will comply with all applicable laws and regulations.
14. COVID-19 safety:
14.1 You must not attend the Event if:
(a) You have been diagnosed as having COVID-19, are feeling unwell with symptoms that may indicate infection with COVID-19, such as fever, cough, shortness of breath, sore throat or unusual levels of fatigue;
(b) You have been diagnosed as having COVID-19 and are currently within your mandatory isolation period;
(c) You have completed your mandatory isolation period but are still experiencing symptoms such as fever, sore throat, runny nose or a cough that is bad or getting worse.
14.2 At entry to and while attending the EVENT, You must:
(a) comply with all applicable laws and health directives concerning COVID-19;
(b) comply with and submit to contact tracing protocols (where decreed by Government or Venue/Event Requirements) and procedures for COVID-19 safety, including but not limited to, registering with a QR Code on entry, or demonstrating that you have down-loaded, to a personal mobile device, the COVID-Safe app, and if requested by EVENT ORGANISERS or the VENUE, you must show proof of full COVID-19 vaccination;
(c) strictly practise social distancing and sanitising measures as required by Government regulations, Venue or Event requirements; and
(e) if you experience any symptoms that may indicate infection with COVID-19, such as fever, cough, shortness of breath, sore throat or unusual levels of fatigue, you must immediately report to Event staff and follow all reasonable directions given by EVENT staff or health professionals present. If requested to leave the venue, REGISTRANTS must comply with that request.

This agreement, comprising this document and the above Terms and Conditions, is entered into between the REGISTRANT and EVENT ORGANSIER.
This agreement governs the Registrant attendance at the EVENT to be held in Melbourne between 31st July - 1st August 2024.
By entering into this agreement and ticking the box, the REGISTRANT acknowledges and agrees that:
• I have read and understand this agreement and the above Terms and Conditions.
• I have read and understand the limitation of liability and indemnity clauses in the Terms and Conditions including as they relate to the Registrant and accompanying persons being REGISTERED.
• I understand that the Terms and Conditions form part of this agreement.
• I understand that by clicking this box I agree to be bound by the Terms and Conditions of this agreement.
